Village of Butler - Bertrand Evans, 24, of Butler was charged with battery, domestic abuse and physical abuse of a child Aug. 20.
Police arrived to the scene around 12:58 a.m. after Evans' wife contacted police. According to the criminal complaint, the couple was having an argument when Evans knocked over a child in the home. His wife confronted Evans for not helping the child back up, at which time Evans grabbed her by the neck and slammed her onto the bed, breaking it, according to the complaint.
A second child came over to the bed to try getting Evans off his wife, when Evans grabbed the child by the neck.
In the report, Evans said his actions toward his wife and the child were done in self-defense.
The first count of battery and domestic abuse is a misdemeanor. If convicted, Evans could face not more than $10,000, nine months in prison or both. The second count of physical abuse of a child could result in a $10,000 fine, imprisonment up to three years and six months or both.
Evans will appear in court at 10 a.m. Oct. 6 at the Waukesha County Courthouse. This is his first criminal offense.
