A DUI suspect told a state trooper early Feb.8 that a closed bar was his apartment, according to state police.

His apartment was actually a mile away from where he claimed to be, according to court records.

Garrett Paul Mcauliffe, 26, of South Schumaker Drive was charged in Wicomico County District Court with resisting arrest, failure to obey a lawful order, DUI and other traffic offenses. He was being held at the Wicomico County Detention Center pending a March 28 preliminary hearing.

State Police said just after 2 a.m. on Wednesday a trooper driving an unmarked cruiser was stopped at the red light at the intersection of South Salisbury Boulevard and Carroll Street when Mcauliffe pulled up next to him. Mcauliffe had stopped partially in the cross walk, court records show.

The trooper followed Mcauliffe to an empty parking lot in the area of Snow Hill Road and Park Heights Avenue, where records show he found the suspect slumped over in the driver's seat. When the trooper approached, Mcauliffe exited his vehicle, records show.

When asked for his driver's license, Mcauliffe reportedly said to the trooper, "What do you need? I'm home. My house is across the street."

The trooper noted Mcauliffe pointed to the Back Street Grill.

State Police said Mcauliffe refused to hand over his driver's license and was unable to maintain enough balance to perform a field sobriety test. When being placed under arrest, records show Mcauliffe tried to tuck his left hand under his chin to avoid being handcuffed. While at the Salisbury Barrack, Mcauliffe was argumentative and had to be picked up to be placed in a holding cell, records show.

Mcauliffe registered a blood alcohol concentration of .21, according to charging documents.
